in that case it looks like parool has some lag in her story;
the letter from May 2010 may or may not have been held back (this story was first floated a few days earlier by someone from eu-claim)
But klm press releases from yesterday mentioned communication from yesterday between eu and klm.
It basically says that the eu is re-thinking if the rules apply in this cases.
(i read it like; we are not re-writing a law, but we don't know if this law apply's)

I just read Het Parool, I don´t make it, so I will say whether or not they are right or even covering the full story.
What I did check however was the quoted meeting of transport secretaries. You can find the press release of it here. In there, it does say:

And so KLM should have been informed, but apparantly wasn´t. That they are debating it again now is a different thing (with a potential different outcome to the whole discussion).that Regulations on air passengers' rights are fully applicable and enforced in a uniform
manner, in the context of such crisis, taking into account the exceptional circumstances. It
invites the European Commission to take into account the experience and the different
reactions of all stakeholders during the ash cloud crisis in the context of the current review
of the Regulation 261/2004

Re: KLM refuses to pay out volcanic ash compensation
Why debate it, if it is already written in the Regulation 261/2004 ?
There should be an indepth evaluation on how the airlines handeled the situation.
To learn from it.
This has now happend twice in 10 years, and could easely happen again.
Make sure the airlines have a workable plan, rather than just fine them.
